This week is a “Power Chords and High Courts” Edition. We will have live, in studio music, from WoolFolk and our panel: T-Bone(@tboneafterdark), Mr. Bunker (@rsbunker), Jimbo (@RaginKurhajian) and I will discuss recent United States Supreme Court Slip Opinions. Here’s a preview of the cases:
Stanton v. Sims, a case resolving the conflict between governmental immunity from civil liability with violations of 4th Amendment rights to privacy. Don’t act surprised when you find out the government can injure you on your property when violating your rights to privacy and not be held responsible for your injuries.
Burt v. Titlow is a relatively technical criminal procedure case dealing with the ineffective assistance of counsel in a murder case and whether or not advising a client to withdraw a plea in exchange for testimony was a good idea. The Court reinforces the “doubly deferential” standard under Cullen v. Pinholster, which gives the benefit of the doubt to both defense attorneys and State Courts in such appeals. The Court also takes the opportunity to ream the 6th Circuit for its misapplication of the law and for “casually second-guess[ing] the decisions of their state-court colleagues or defense attorneys.”
And finally, we will discuss Kansas v. Cheever, a case dealing with the 5th Amendment right against self incrimination, the rights to medical privacy, and is another example of the State winning every time when it comes to individual rights.
